Athenode ("we", "us", "our") provides a spec-driven development platform. These Terms of Service ("Terms") govern your access to and use of the platform. By creating an account or otherwise using the service, you actively accept these Terms and our Privacy Policy, which together govern your use of Athenode and your personal data.

Acceptance

Using the service requires you to actively accept these Terms, together with our Privacy Policy, as a single combined step during account creation. If you do not agree to both, you may not use the service.

Commercial terms

Athenode offers both a free tier and paid subscription tiers.

• Free tier: available at no cost, subject to usage limits described on our pricing page.
• Paid subscriptions: billed on a recurring basis and auto-renew at the end of each billing period unless cancelled before renewal. We do not provide refunds for periods already paid.
• Price changes: we may change the price of a paid subscription at any time, but we will give you at least 30 days' advance notice before any price change takes effect for your account.

Content & data rights

• Sharing and exclusivity: once you share content with other members of a project or platform-wide, you no longer hold exclusive rights to it — other members with access can continue to view and use it.
• License to us: by submitting content to the platform, you grant us a broad, non-exclusive, worldwide license to host, use, reproduce, and process that content as necessary to operate and improve the service, including for analytics and service-improvement purposes. This license is mandatory (there is no opt-out) and survives termination of your account or these Terms.
• Private content: the same baseline license described above also applies to content you have not shared with anyone else, to the extent necessary to operate the service.
• Content shared with others: if you delete your account, content you previously shared with other members remains accessible to those members — deleting your account does not retract access already granted to others.
• Content generated outside the platform: content created using the platform's tools (for example, code generated by an AI agent) but not stored or hosted on the platform belongs to you.
• No export guarantee: we do not guarantee that you will be able to export your data before your account is suspended or deleted.

Liability, warranties & disputes

• Limitation of liability: to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to these Terms or the service is capped at the amount you paid us in the 12 months preceding the claim. The service is operated by an individual rather than a registered limited-liability company, so this limitation is not backed by a separate corporate liability shield; it applies only to the extent permitted by applicable law.
• No warranty: the service is provided "as is" and "as available", without warranties of any kind, express or implied, and without any service-level agreement (SLA).
• Indemnification: you agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the service or your violation of these Terms.
• Other users: we are not liable for the actions, content, or conduct of other users, including content or configurations (such as AI-agent setups) shared by other users, or for any harm resulting from them (for example, prompt injection or malicious behavior embedded in a shared setup).
• Third-party integrations: we are not responsible for the availability, accuracy, or conduct of any third-party services or integrations you connect to the platform.
• Out-of-court settlement: where available under applicable Polish consumer-protection law, you may pursue out-of-court (alternative dispute resolution, "ADR") settlement of a dispute, in addition to the standard court-based process described below.
• Dispute resolution: any dispute arising out of or relating to these Terms or the service that is not resolved out-of-court (see above) will be resolved by the courts of Poland, as set out in the Governing law section below.

Acceptable Use Policy

You must be at least 18 years old to use the service. You agree not to:

• reverse engineer, decompile, or disassemble any part of the service;
• scrape, crawl, or otherwise systematically extract data from the service;
• abuse, spam, or interfere with the normal operation of the service;
• upload, store, or distribute illegal content;
• attempt to bypass plan limits, rate limits, or other technical restrictions; or
• create or distribute malicious AI-agent setups, including those designed to perform prompt injection or execute malicious code.

Any violation of this Acceptable Use Policy is grounds for immediate suspension or termination of your account, without prior warning.

Governing law

These Terms are governed by the laws of Poland, and any dispute not resolved through the process described above is subject to the exclusive jurisdiction of the courts of Poland. The service is operated by Oleksii Hlushenok, an individual based in Poland, trading as Athenode.
