Terms of Service

Athenode ("we", "us", "our") provides a spec-driven development platform: the free athenode software that runs on your own computer, the self-hosted Athenode Pro server, and an online service (the "service") for Athenode accounts, organisations and their billing, Athenode Pro licenses and install tokens, and the plugin library. These Terms of Service ("Terms") govern your access to and use of the service and of the software we distribute. By creating an account or otherwise using the service, you actively accept these Terms and our Privacy Policy, which together govern your use of Athenode and your personal data.

Acceptance

Using the service requires you to actively accept these Terms, together with our Privacy Policy, as a single combined step during account creation. If you do not agree to both, you may not use the service.

Software you run yourself

  • Where your work is kept: the athenode software and Athenode Pro run on computers that you or your organisation control. Your projects, specifications, ToDo cards and plugins are stored there, not on the service, and you are responsible for them, for who can reach them and for their backups.
  • Licenses: the athenode software is free to use. Athenode Pro needs a valid license for its seats, which an organisation buys as a seat pack. Running Athenode Pro with more enabled accounts than its license covers, or without a valid license, is not permitted.
  • No telemetry: the athenode software sends no usage data to us. It contacts the service only when you ask it to, for example to browse, install or publish plugins of the plugin library, and it checks the public npm registry for a newer version.

Commercial terms

Athenode offers a free tier and paid subscriptions.

  • Free tier: the athenode software, an Athenode account and the plugin library are available at no cost.
  • Paid subscriptions: Athenode Pro seat packs, bought by an organisation, are billed on a recurring basis and auto-renew at the end of each billing period unless cancelled before renewal. We do not provide refunds for periods already paid, except as described in our Refund Policy.
  • Price changes: we may change the price of a paid subscription at any time, but we will give you at least 30 days' advance notice before any price change takes effect for your account.

Subscriptions and payments

  • Merchant of Record: paid plans (Athenode Pro seat packs) are sold per organisation through our online reseller Paddle.com, which acts as the Merchant of Record and reseller for all orders. Paddle's Buyer Terms therefore also apply to your purchase, and Paddle handles payments, invoices, taxes and refunds.
  • Auto-renewal: a subscription is billed monthly or annually, depending on the billing period you choose, and renews automatically at the end of each period until you cancel it.
  • Cancellation: you can cancel at any time. Cancellation takes effect at the end of the current billing period; the paid plan stays active until then and you are not charged again.
  • Plan changes: a change to a larger pack or from monthly to yearly billing takes effect immediately and is prorated for the rest of the current billing period; a change to a smaller pack or from yearly to monthly billing takes effect at the end of the current billing period.
  • Former per-project plans: the per-project plans (Solo, Team and Business) and the projects kept on the service ended with the release of 2026-10-19. No such plan can be bought or renewed.
  • Taxes: prices are shown excluding tax. Paddle adds any applicable taxes (such as VAT or sales tax) at checkout.
  • Refunds: refunds are covered by our Refund Policy, including a 14-day money-back guarantee on the first payment of a subscription.

Content & data rights

  • Sharing and exclusivity: once you share content platform-wide, for example by publishing a plugin to the plugin library, you no longer hold exclusive rights to it: other users with access can continue to view and use it.
  • License to us: by submitting content to the platform, you grant us a broad, non-exclusive, worldwide license to host, use, reproduce, and process that content as necessary to operate and improve the service, including for analytics and service-improvement purposes. This license is mandatory (there is no opt-out) and survives termination of your account or these Terms.
  • Private content: the same baseline license described above also applies to content you have not shared with anyone else, to the extent necessary to operate the service.
  • Plugins published to the library: when you publish a plugin to the plugin library, you share it platform-wide: every signed-in user can view it and use it in their own projects. The license above covers this. If you turn on public display for a published plugin, the license also covers showing that plugin's name, description and category and the full content of its agents, skills with their bundle files, rules and plugin files on our public website (lib.athenode.com), where anyone can see them without an account and search engines may index them. Its MCP server configuration is public too: anyone can install the plugin, MCP servers included, into their own project without an account, with the Athenode CLI (athenode use). This applies to every version of the plugin that you publish while public display is on. Public display is off unless you turn it on, and you can turn it off at any time; the plugin is then removed from the public website within about a day, although search engines may keep copies for longer.
  • Reports: signed-in users can report a published plugin to us, choosing a reason and optionally adding a comment. Our administrators review reports and may stop showing a plugin on our public website; the plugin then stays available to signed-in users in the plugin library. If we do so, we notify the publisher by email, naming the reason, and the publisher can appeal by writing to support@athenode.com. Reports, and who made them, are not shown to the publisher.
  • Automated content checks: we automatically check the content of a plugin when it is published, when a new version of it is published and when public display is turned on for it. A check that finds suspicious content creates a report for our administrators; it does not remove or hide anything by itself, and it does not relieve you of your responsibility for the content you publish.
  • Public counts: for a plugin with public display on, the number of times it was liked, the number of projects that added it on the service before 2026-10-19 and the number of times it was installed with athenode use are shown on our public website.
  • Installing public plugins: anyone, with or without an account, can install a plugin with public display on, with its MCP server configuration, using athenode use. These installs are limited per IP address. A plugin installed this way is content of another user, as described under "Other users" below: review it, and its MCP servers in particular, before you use it.
  • Plugins published before 2026-10-19: library entries published from projects on the service before that date were kept as standalone copies when the projects were removed from the service. An entry whose publisher can no longer be determined is held by Athenode's own organisation; its original publisher can write to support@athenode.com to have it transferred or removed.
  • Published plugins after account deletion: if you delete your account, plugins you published remain available to signed-in users as described above, but they are removed from the public website.
  • Content generated outside the service: content created using Athenode (for example, code generated by an AI agent, or the specifications and plugins kept by the athenode software or your Athenode Pro server) but not stored or hosted on the service belongs to you.
  • No export guarantee: we do not guarantee that you will be able to export your data before your account is suspended or deleted.

Liability, warranties & disputes

  • Limitation of liability: to the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, and our total liability arising out of or relating to these Terms or the service is capped at the amount you paid us in the 12 months preceding the claim. The service is operated by an individual rather than a registered limited-liability company, so this limitation is not backed by a separate corporate liability shield; it applies only to the extent permitted by applicable law.
  • No warranty: the service is provided "as is" and "as available", without warranties of any kind, express or implied, and without any service-level agreement (SLA).
  • Indemnification: you agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the service or your violation of these Terms.
  • Other users: we are not liable for the actions, content, or conduct of other users, including content or configurations (such as AI-agent plugins) shared by other users, or for any harm resulting from them (for example, prompt injection or malicious behavior embedded in a shared plugin).
  • Third-party integrations: we are not responsible for the availability, accuracy, or conduct of any third-party services or integrations you connect to the platform.
  • Out-of-court settlement: where available under applicable Polish consumer-protection law, you may pursue out-of-court (alternative dispute resolution, "ADR") settlement of a dispute, in addition to the standard court-based process described below.
  • Dispute resolution: any dispute arising out of or relating to these Terms or the service that is not resolved out-of-court (see above) will be resolved by the courts of Poland, as set out in the Governing law section below.

Acceptable Use Policy

You must be at least 18 years old to use the service. You agree not to:

  • reverse engineer, decompile, or disassemble any part of the service;
  • scrape, crawl, or otherwise systematically extract data from the service;
  • abuse, spam, or interfere with the normal operation of the service;
  • upload, store, or distribute illegal content;
  • attempt to bypass license seat limits, rate limits, or other technical restrictions; or
  • create or distribute malicious AI-agent plugins, including those designed to perform prompt injection or execute malicious code.

Any violation of this Acceptable Use Policy is grounds for immediate suspension or termination of your account, without prior warning.

Governing law

These Terms are governed by the laws of Poland, and any dispute not resolved through the process described above is subject to the exclusive jurisdiction of the courts of Poland. The service is operated by Oleksii Hlushenok, an individual based in Poland, trading as Athenode.
